METHOD OF SALE: The parcels will be offered on a per acre basis with bidders choice and privilege and also in combination. They will sell the way they bring the most.
TERMS: We require a non-refundable down payment of 10% of the purchase price at the close of the auction with the balance to be paid in full at closing. A buyer’s premium of 3% will be added to the successful bid to determine the contracted selling price. There are no financing contingencies.
SURVEY: The seller will pay for all survey costs plus the fees for soil tests and septic plot plans if required by the county.
TAXES: The taxes on this farm will be pro-rated to the day of closing based on its current CAUV value.
TITLE: The seller will provide a warranty deed w/certificate of title at their expense and will split the fee for an Owner’s Policy of Title Insurance.
POSSESSION: Immediate possession will be given at closing. Permission to farm will be given with the down payment.
MINERAL RIGHTS: The seller will retain the free gas allotment from the producing well on the farm for his existing home as well as the minimal royalty. Should there be a new well drilled the new owners will share in the royalty from that production.
DEED RESTRICTIONS: No mobile homes. Modular homes are to be built on a permanent foundation. No junk yards. No large commercial poultry, swine, sheep, or cattle feeding facilities.
ORGANIC CERTIFICATION: The entire farm is currently certified as organic. It will be up to the new buyer to maintain that certification if desired.
